1. What is Waqf Board? Its history, functioning and powers

Waqf Board is an organization that manages the properties given by the Muslim community for religious, social and charitable purposes. Waqf properties are spread on a large scale in India and are administered under the Waqf Act, 1995. Waqf properties are mainly used for mosques, madrasas, cemeteries, orphanages and social work.

What is Waqf?

Waqf is an Islamic tradition in which a person dedicates his property for religious and welfare purposes. This property cannot then be used for any personal use and cannot be sold or transferred. Waqf properties are usually used for helping the poor, education, medical and religious works.

There are two types of Waqf properties:

  • Religious Waqf – which is used for mosques, dargahs, madrasas etc.
  • Charitable Waqf – which is used for social services like orphanages, schools, hospitals.

History of Waqf Board

The Waqf system in India dates back to the Mughal period, but more control was established during the British rule. After the partition of India in 1947, many Waqf properties became disputed. Following this, the government passed the Waqf Act, 1954, which was amended in 1995.

Today, there are 32 State Waqf Boards across India and these are administered by the Central Waqf Council (CWC), which comes under the Ministry of Minority Affairs, Government of India.

How does a Waqf Board work?

Formation of Waqf Board: A State Waqf Board is formed in each state, which manages the Waqf properties. Economically weaker sections can get more benefits from Waqf properties.

Maintenance of Waqf Properties: The board ensures that the properties are used for the right purposes.

Legal control: The Waqf Board can take legal action to protect properties from illegal occupation.

Management of revenue and rent: Rent and revenue received from Waqf properties are used for social and religious activities.

Resolution of disputes: If there is a dispute over a property, the Waqf Board can intervene.

Powers and rights of Waqf Board

  • Register and monitor Waqf properties.
  • Take legal action to free Waqf properties from illegal occupation.
  • Control the rent, income and management of properties.
  • Provide financial assistance for religious, educational and social works.
  • Submit reports to the government and the court.

Status of Waqf properties in India

  • The Waqf Board has more than 8 lakh properties in India.
  • These properties include mosques, madrasas, graveyards, agricultural land, commercial buildings and hospitals.
  • The total value of the Waqf Board’s properties is estimated in lakhs of crores of rupees.

However, many Waqf properties remain embroiled in disputes due to illegal occupation and mismanagement. The government keeps planning to make reforms from time to time to bring transparency in the management of the Waqf Board.

Recent changes and government plans related to Waqf Board

Recently, the government has planned to amend the Waqf Act, so that

  • more transparency can be brought in the management of Waqf properties.
  • removal of illegal occupation and commercial use of properties can be streamlined.
  • economically weaker sections can get more benefits from Waqf properties.

Conclusion

The Waqf Board is an important management body of the properties and social welfare schemes of the Muslim community in India. However, it needs to be made more transparent and effective. The reforms being made by the government are expected to ensure proper use of Waqf properties and its benefits reach more and more people.
